Motoring Law
As per the transparency rules, we are required to provide price information for assistance in relation to summary only motoring offences under Part 1 of the Road Traffic Act 1988 and S 89 of the Road Traffic Regulation Act 1984.
We have an experienced team who can assist you and provide appropriate advice and represent you at every stage of the proceedings.
Legal aid is not always available for most of the driving offences. If legal aid is available, we will advise you on your eligibility. Where it is not available, we offer you a service either on a fixed fee basis or on hourly rates.
Our fees will vary depending on whether it is a guilty or not guilty plea and the number of court hearings.
Guilty Plea – Fixed fee
The fixed fee for representation at first court appearance which concludes on the same day is £500.00 plus VAT (London only).
If outside London the fee will be £750.00 plus VAT.
For every additional hearing the fee will be £300.00 plus VAT (London Only) and £400.00 plus VAT (Outside London).
The above fee includes the following:
Attendance/Preparation up to 2 hours
Obtaining and considering evidence
Taking your instructions
Advising on procedure, law and the offence
Advising on the strengths and weaknesses of the case against you
Providing advice in relation to your plea, likely sentence and options available to court
Where appropriate, advice on whether an exceptional hardship or special reasons arguments should be made to court
Representation at a single hearing at the Magistrates Court
Letter confirming the outcome of the hearing and advice on next steps
The above fee does not include the following:
Instruction of any expert witnesses
Taking statements from any witnesses
Advice and representation in relation to special reasons hearings
Advice or assistance in relation to any appeal
Representation at any additional hearings including trial, exceptional hardship and special reasons hearings
Reasonable disbursements such as travel costs and parking charges
Not Guilty Plea
For not guilty plea and all other work not included in the fixed fee, we deal on an hourly rate basis exclusive of VAT which are as follows:
£250 per hour for solicitor of more than 8 years qualification
£215 per hour for solicitor of more than 3 years qualification
£175 per hour for all other solicitors
£125 per hour for trainee solicitors and paralegals
We will provide an estimate of the number of hours and costs when we discuss with you about your case.
Key Stages
The key stages of your matter may vary due to individual circumstances which may be as follows:
Meet with your solicitor to provide instructions
We will consider the initial disclosure provided with any other evidence and provide advice
We will arrange to take any witness statements if necessary where an additional cost has been agreed
We will explain the court procedure to you so you are fully aware what to expect on the day of your hearing and the sentencing options available to the court
We will conduct any further preparatory work within the timeframe of the agreed fixed fee and obtain your instructions and any follow up queries
We cannot provide a timescale of when your hearing will take place as this depends on the court listing and fixtures on that day.
We will attend court on the day and meet you prior appearing before the court. We would allow half a day
We will discuss the outcome of the court hearing with you, next steps including appeal and any additional costs
We assure you that we aim to provide a very high quality service at affordable prices.
Timescales
First appearance in court can range from 2-6 weeks after you being charged or sent a postal summons to attend court. If you entered a guilty plea, the case may conclude on the same day or adjourned to attend a later date for sentence. If a not guilty plea entered it may take from 8 weeks to 6 months depending on the availability of court and length of the case. Please also note we cannot provide an exact time of when your hearing will take place, as this will depend on the court listing on that day.
